Welcome to CommendFood. These Terms of Service ("Terms") govern your access to and use of the CommendFood platform, including our website, mobile applications (Android and iOS), and any related services (collectively, the "Service"), provided by Ducal Studio Sdn. Bhd. ("CommendFood", "we", "our", or "us"). By using or accessing the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Use of Service
CommendFood is a platform for discovering restaurants and dishes, sharing reviews, ratings, photos, and food‑related content, and engaging with a community of users interested in food.
You may use the Service for lawful, personal, non-commercial purposes only, and only in compliance with these Terms.
2. Account Registration & Responsibility
Some features require you to register an account. When you register or update your account information, you agree that:
- All information you provide is accurate, current, and complete.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You will notify us immediately of any unauthorized use of your account or other security breach.
You agree not to: create multiple accounts, impersonate others, use false information, or let others access your account in unauthorized ways.
3. User Content
3.1 What is User Content
"User Content" means any content you post, upload or submit through the Service — including but not limited to restaurant reviews, dish photos, ratings, comments, text, and any other materials.
3.2 Your Rights & Responsibilities
By submitting User Content, you confirm that:
- You own or have the rights to submit the content.
- The content does not violate any law, or third‑party rights (copyright, privacy, publicity, etc.).
- You are not uploading harmful code (viruses, malware) or content promoting hate, violence, illegal activities, or harassment.
3.3 License Grant to CommendFood
You grant CommendFood a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, adapt, modify, publish, display, distribute, and otherwise exploit your User Content in connection with the Service — including on our website, apps, marketing materials, or social media.
3.4 Moderation & Removal
We reserve the right (but are not obligated) to review, moderate, remove, or disable access to any User Content at any time for any reason, especially when content violates these Terms.
4. Prohibited Conduct
When using the Service, you agree not to:
- Post content that is illegal, abusive, hateful, obscene, defamatory, or discriminatory.
- Upload content you do not own or have permission to use.
- Harass, threaten, or defame other users.
- Use the Service for spam, unsolicited marketing, or promotional messages without expressed permission.
- Attempt to hack, reverse-engineer, disrupt, overload, or interfere with the Service or its infrastructure.
- Collect personal information about other users without consent.
- Manipulate ratings, reviews, or data to misrepresent restaurants or dishes.
- Share false, misleading, or fraudulent content.
5. Advertising, Monetization & Third‑Party Services
CommendFood may display advertisements, sponsored listings, or promotions and may integrate third-party services (such as analytics providers, ad networks, mapping services, or social login). Your use of those third-party services is subject to their terms and policies.
If advertising partners are used (for example AdMob), data collection and ad delivery will follow our Privacy Policy.
6. Privacy & Data Use
Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in that policy.
7. Modifications to Service or Terms
We may change, update, or discontinue any part of the Service (features, content, design) at any time. We may also revise these Terms. We will provide notice of material changes by posting updated Terms on the Service. Your continued use of the Service after changes indicates acceptance of the updated Terms.
8. Suspension, Termination & Account Deletion
We reserve the right to suspend or terminate your access, or delete your account and content, if we believe you have violated these Terms or behaved in a way that could harm the Service or other users.
You may request deletion of your account at any time through the app settings or by contacting us at [email protected]. Deletion may take some time to process.
When your account is deleted:
- Your personal information (name, profile details) will be anonymized or removed.
- Your profile photo and other uploaded media will be removed.
- Your reviews, ratings, photos, and other User Content will be removed or disassociated from your identity.
- Your bookmarks, likes, favorites, and other saved preferences will be permanently deleted.
Account deletion is permanent and cannot be reversed once processing is complete. We recommend downloading any data you wish to keep before requesting deletion.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of any content (including restaurants, menus, reviews, photos) provided by users. Your use of the Service is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, CommendFood, its officers, employees, agents, affiliates, or partners, will not be liable for any indirect, incidental, special, punitive or consequential damages arising out of or related to your use (or inability to use) the Service. Our total liability to you for any claim related to the Service or these Terms will not exceed the amount you have paid us (if any) in the preceding six months.
11. Indemnification
You agree to indemnify, defend, and hold harmless CommendFood and its affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or violation of these Terms.
12. Children & Minors
The Service is intended for a general audience. CommendFood does not knowingly collect personal information from minors under applicable minimum age thresholds. If we learn that we have collected personal data from a child, we will take steps to delete that data. Parents or guardians who believe a child's data is stored can contact us at [email protected].
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Malaysia without regard to conflict of law provisions. Any dispute arising from or relating to the Service or these Terms shall be resolved exclusively by the courts located in Kuala Lumpur, Malaysia.
14. General Provisions
- If any provision of these Terms is found invalid or unenforceable under applicable law, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect.
- These Terms, the Privacy Policy, and any supplemental policies posted by CommendFood constitute the entire agreement between you and CommendFood regarding the Service.
- Any failure by CommendFood to enforce any right or provision does not constitute a waiver of that right or provision.
- CommendFood may assign or delegate its rights under these Terms; you may not.
